In California, child custody is determined by what is in the best interest of the child. A variety of factors can be taken into consideration in negotiating custody, including each parent’s living situation, the child’s age and health, the child’s relationship with each parent, the ability of each parent to care for the child, and more. If there is a history of issues such as abuse, domestic violence, or substance use, that will be considered, too.
